Working women rights in dv

(Querist) 24 January 2016 This query is : Resolved
My Sister is staying away from her husband from last one year and two months back she filled a DV against her husband, seeking maintenance for her and her two year old daughter.
In a recent hearing, her husband state that as she working so she cannot ask maintenance from him.
Now my query is that is it possible (according to law) that as she is working so she don't have any right for maintenance?
Is she ask maintenance for her daughter?
what are her other rights (apart from maintenance) she can have in DV?
Devajyoti Barman (Expert) 24 January 2016
If her earning is at apr with her husband no monetary reliefs would be provided to her.
Only in case of great disparity of respective incomes the court grant maintenance.
Yes, the daughter is nevertheless entitled to maintenance from her father.
She can claim for return of stridhan and compensation out of mental agony.

If earning enough to maintain life style, maintenance payment is doubtful, for daughters, she should claim.

I agree with DJ Barman.
