I am from goa. My great grandfathr was having two wife. First wife is having one son and second wife is also having one son who is my grandfather. Now the whole property is registered in the name son of first wife who is issueless. Now my father who is son of second wife son of my great grand father. My father has instituted inventory proceeding with respect to whole property. Now mutation process is going on in mamlatdar office and cousin brothers of estate leaver have filed objection stating that second marriage of my great grand father is not registered in any office as such we do not possess any rights in the property.does marriage registration is necessary in goa to claim any right. What should i do ???

The Special Marriage Act and Hindu Marriage Acts came into force from 1954 and 1955 respectively and hence marriage registration is not compulsory if he married the second wife before 1954. however the second wife's marriage is not registered her children can claim their over the property. file a suit in a court of law for your share by consulting a local counsel.

Now cousin brothers of estate leaver filed civil suit and their claim is that my great grandfather has only one wife and we are no way connected to their family. I do not have any record regarding second marriage of my great grand father. Please guide me what should i do ??
