Name spelling wrong on stamp

Hi sir,
Just two days back we bought a land and saw my name had spelling mistake instead of Parmanand Singh by mistake it's printed as Parmatmanand Singh Seller sold his ancestors property and left for delhi. Person who was involved to do the documentation says he will correct my name on the stamp and all Xerox except the details which were loaded into computers while registering.
So basically on stamp handwritten "Parmatmanand" and on backside computer printed name is not matching.Other references on backside of stamp is correct. All other references of my name on Seller is not willing to come soon. How should I proceed further. Is it possible to correct name without sellers presence? Any other alternative to full fill his absence?

A rectification deed can be prepared and the same can be registered.

For the Rectification Deed the Presence of both the Parties are Required.Other wise A suit under section 26 of Specific Relief Act 1963 before the concerned court to be filed and the court shall Order the deed to be Rectified after ensuring the Real Intention of the Party is not reflected in the deed.Discuss with your local Good Advocate

If the name typed in the deed itself is error, it can be rectified by rectification deed. The rectification deed requires both the parties.

If the endorsement made by the stamp vendor on writing your name on the face of the stamp paper is error and the spelling in the deed typed by document writer or the advocate is correct, it has no much problem, leave it.

Search the seller and get the rectification deed prepared.

Any subsequent adding / alteration on the original document after registration may leave the document illegal / invalid.

Thanks for your kind comments, here is what has been done-

Document write took the original from registry office and corrected the name on stamp paper and have added a remark on last page of stamp that the name spelling was changed and then registrar checked all papers and other details and signed the registry. So Kharara khatani will reflect the correct name "Parmanand Singh" from starting. But the scanned copy which was loaded to central server is referencing to old copy of registry.

I am still not very much happy about it and thinking to do a proper rectification filing once seller comes to native place . Is it fine to rectification after/within 6 months.

WITH THE CONSENT OF OTHER PARTY CORRECT THE ERROR THROUGH A RECTIFICATION DEED.

Indeed, rectification deed may take some time (max 6 months) but for sure I would file it with the consent of other party . Thanks for the reply .

If the correction has been effected on both the copies, there should be no problem. Prey the registrar to rectify the uploaded copy, if there exist any such procedure.

Hi rajendra, I think uploading rectified copy needs both the parties to be available to use their thumb impression. This is my guess but if it's possible I will try my best to do so.

Earlier I had not noticed.Addressing the Advocates here with HI and now addressing a Senior Expert/Advocate with "HI' and addressing with Name with out even Mr Or Sir.Very Good

Rectification has been effected on both the copies, Same amended copy need be uploaded. no need of any party presence.

Sir, I will have to check with locals, Really not sure if amended copy can be directly uploaded to central system. May be registrar can instruct them.( Though It's my guess ). tomorrow I will update my findings here .
