Out of 7 cosharere in a property suit if 5 members Sale the shop with out the knowledge of 2 remaining sharer although case pending in court what remedy is left and can buyer be challenged in court

Purchasing of share of 5 without knowledge of 2 is not illegal. Even case pending, unless the Court has granted stay on transfer.

Any Transaction during the Status of Case Pending in the Honorable court is Illegal and Legally Invalid and the Court's Final Decision will Not be affected by this.Better to Inform the Court about this.

Any share holder can sell / gift / mortgage / bequeath a will for his undivided share in the property if partition has not been agreed / court has not stayed such move.

The court has given stayed on the property and passed status quo orders. Presently case on arguments and final order pending.
