on what basis patta is generaly issued. is there any restriction to issue patta for main road property.i was said by expert that after 12 years of enjoying the property patta will be issued and if i buy the property now whether i have to wait for 12 years.

A patta is a subject matter of contract between the owner(lessor) and the person intending to have permissive possession(lessee) and they may opt to have contract in the manner they mutually agree upon. However, when the owner is enjoying ownership rights subject to certain restrictions/conditions, he is bound by the same and can lease out subject to those restrictions/conditions. In some cases, the property is subject to certain restrictions from government agencies then also those conditions are to be fulfilled and the patta(lease) is subject to those conditions.

Patta shows the person in possession of the property. THe issuance of patta is governed by the Patta Passbook Act

'Patta' is a revenue record. Whenever there is a change in the ownership by way of any registered deeds such as sale, partition, release, settlement, gift, the current owner has to apply for mutation of revenue records on the basis of such documents. There is no need to wait for 12 years or so.

Patta is document containing Detailed list of the fields comprising a Royt's Holding as it stood when the patta was drawn up and given to Royt .Although the grant of patta does not give conclusive title to the land .etc it is important to Royt as it gives the full details of his holding and give him information about the amount of land Revenue which has to be apid to the Govt -

The Patta nature to be considered . Private Patta lands with alienable rights , sales , gifts , Partition etc and mutation of patta on the basis of such transactions and along with Patta Possesison will be recorded in Pahanies .
Whenever the title / rights / interest in the agri land is changed in favour of other person the mutation of Patta is required
Under AP Rights in land and Pattedar Pass Book Act 1971 the rigths of the parties are up dated and New ROR Title and Pattedar Pass Books are issued to individual Royts according to the nature of his rights in the land . Patta Mutation is made in Pahanies and possession is recorded in his name .
