WHAT LEGAL DOCUMENTS REQUIRED???

(Querist) 15 March 2010 This query is : Resolved
WE are 2 friends, purchased a flat in equal investments. I have paid my share through cheque and my friend had taken loan to pay his sharing. Flat registered in my friend name that's why all authority to him. I don't have any authority about said flat.

So my question is what legal documents or requirements want to get authority to me about said flat???

It is advisable to execute DEED OF OWNERSHIP or a DEED OF CO-OWNERSHIP wherein your friend can surrender the half share to you and also state that half of the purchase price has been paid by you and you are also a co-owner of the flat. You shall register it compulsorily.

Unless the flat is registered in your name as a co-owner/joint-owner, you will not have any title or ownership in the said flat. If you have paid money through cheque for purchase of flat to your friend, you are entitled only to recover the amount and nothing more.

Remedy has been well suggested by Sri R. R. Krishnaa.

I have similar opinion as of all other experts on this matter.
