Sex before marriage

sir,
if a guy goes in sexual relationship with her girl friend keeping her in faith that he will only marry her , and ditches her later, is it a crime under the laws of indian constitution????

Unless at the very inception of the promise of marrying he had no intention to marry, he cannot be charged. If he had no intention from the outset of marrying the girl, and induced her, with the promise of marriage, to consent to sex,he can be charged with rape.

I endorse Ld.Ashish Ji's opinion, if he at the time of obtaining the girl's consent intention of marriage, but subsequently due to change of circumstnaces is not able to marry - then consent is not negatived and rpae is not made out.

As the querist has openly told that the intension at the time of intercourse was to marry her but subsequently he changed in mind or he had already in his mind not to marry but did the intercourse with the girl under the promise to marry her is definitely a crime and such person is liable to be prosecuted under section 378 IPC apart from other sections of IPC.
