In criminal procedure code Sec 31 of dva is a offence IS
1/ it can be trialed by an application directly to an jmfc.
2/ it can be registered by section 202 of crpc by taking conginance by jmfc.
3/ it can be registered through a citcation giving by jmfc as witness for registry of case under sec. 31 of DVA.
4/ it can be summoned without 204(2).
5/ Is there no domestic relation between husbend and wife since 3 yeras.
6/ wife living seperatly from husbend then DVA is trialable.
