Legal action

(Querist) 22 July 2013 This query is : Resolved
Sir,
I am owner of a commercial premises in a mall & I am regularly paying the maintenance bill. Since one year I am not able to pay the maintenance bill because the society imposed 3 to 4 years assessment tax in to the maintenance bill in full i.e. approx 80,000/- because only maintenance bill I cannot pay. Society will accept the full amount of maintenance bill including the amount of tax also. From then I am not able to pay the bill. And every month charging 20% interest also. Now it become approx 1,00,000/- One day society cut of my electricity, when I asked they said pay the maintenance bill and the will start the electricity. After so many discussions they started electricity. In our mall there are so many people are not paying maintenance from that date. Now society issued me a notice that within 15 days make the payment otherwise take legal action. In our mall more than 100 members are like me. But they are against me to take personal revenge. Now what I can do? What is legal proceedings for nonpayment of maintenance bill? Can I do anything to the society because they are taking action against me only?
Can I ask the society the list of defaulters?

ask society to furnish list of defaulters . as member you have right to obtain such information on payment of nominal charges . ultimately you have to pay the maintenance bill .if you are unable to pay sell off your premises

Maintenance bill has to be paid. You may request to accept the payment in installments.

If not settled amicably, Contact local lawyer with all the documents.

I do endorse the advice of Rajender.
