Maintain status quo

Sir,

1. In one of the cases, we are dealing with, teh Supreme Court has not yet admitted or stayed the Kar. HC judgement. It has asked the parties to maintain status quo. What is this - does this amount to stay?

2. When the supreme court stays the HC judgement, or HC of the lower court...does it mean that the parties should maintain the position that they were in when for the first time a case was filed in a lower court, even if lets say a high court has reversed the judgemet and still higher court has stayed that judgement?

1&2. Yes, sort of.
There is ambiguity in understanding the term of ' status quo' and hence supreme court makes it a point to remind that while passing order of status quo do make the existing status clear.

1. status quo means both the parties must

remain in their present respective position.

2.SC/HC stays the order of lower courts till

pendancy of appeal only.

It means maintain the position/situation of the thing as it is.

'Status quo' is a Latin term meaning the existing state of affairs.

When Court passes an order asking parties to maintain 'Status quo' it means that subject matter of dispute would be preserved in same position without any change as it is on the date of order passed.

Status quo means the position to remain same as was before entering in that court.
