Consignment lost booked in transport

Dear Sir,
We are one the private partnership firm in coimbatore. we have booked a consignment of two boxes in a reputed transport service. Out of two boxes, one box was delivered correctly and another one box found missing. We have not insured the consignment since we are not aware of transit insurance.We are daily follow up with the tarnsport for nearly 01 month but no use.
Kindly advice us.

While Consumer complaint after service of notice,as suggested by experts is your remedy you have not stated if transporter is a Multimodal Transport registered under The Multimodal Transportation of Goods Act, 1993 (MMTG).
The Supreme Court held the liability of a carrier to whom the goods are entrusted for carriage is that of an insurer and is absolute in terms which means the carrier has to deliver the goods safely, undamaged and without loss at the destination. The court also observed that "the expression, 'owner risk', does not exempt a carrier from his own negligence or the negligence of his servants or agents."(Nath Brothers v. Best Roadways Limited, 2000 CTJ 335(SC)(CP)

Agreed with Mr.Prabhakarsingh. In the meanwhile pursue with the transport company as to what action they have taken till now. One month is not a big time as they are have to find out where the goods have reached and they have deport them from that place to the correct destination. If you are satisfied with their efforts, you can give some more time.
