Inheritance

(Querist) 25 September 2014 This query is : Resolved
Great-Grandfather bought the property. His 4 sons distributed the property in 4 parts, made their individual houses. One of these parts was owned by my Grandfather.

Upon his demise, he willed the money (from selling of this property) to his grandchildren (i.e. me, my brother and 2 of my mama's children).

Initially, the plan was to sell the ENTIRE property as a WHOLE. So my mama along with my mom spoke with their cousins to set up the deal.

Now, it seems that none of the other 3 parties are interested in selling their part of the ENTIRE property, however my family stands united in wanting to sell our share.

Please tell us what are our options. Also, if you could guide us with specific Acts/Laws in our constitution, it would be of great help.

when did your great grand father die? whether any deed of partition was executed between 4 sons ? was it duly stamped and registered?

All the documents pertaining to the property and time of events need to be referred, consult local lawyer.

I just want to know, that if all the documents pertaining to the property and time of events are in place, is there a provision in our law system where I can individually sell our share of the property. That is 1/4th of the entire property. Or maybe get some sort of a bond from the govt stating we are rightful owners of that chunk and we can sell this bond to a third party?

Without knowing the history of the property and its partition details, it will be difficult to give any opinion to your query, hence better consult a local lawyer, narrate him the entire details along with the relevant papers/documents, get his opinion and proceed as per his advise.
