Entitlement to be appointed on 'compassionate' grounds by the employer of a family member of an employee who dies while in service is not a matter of right. Each company will have its own guidelines regarding such appointments. Presuming the company, may be government or private, in the instant case, has such a guideline, an application for appointment has to be made within the time limit fixed for that.

When the sons are grown up and have attained majority, they are treated as individual persons and eligible for making application for such a job. Wives are not entitled as they are already employed. Both the sons can make application.

The company would consider their application sympathetically and on compassionate grounds keeping in mind their educational qualification, experience if any, capabilities to work and also the vacancy that is existing in the company.

Role of trade union would be of considerable value in such approaches

One of the wife is already in job and another has a son with her. That son shall get preference to her sister as seen practically. Departments also take into consideration the harness factor into their consideration while deciding rival applications.

Sri Raj Kumar Makkad is correct. It is better both the son and the daughter make an application and meet the management. If one's qualification and experience is not suitable, other one's my be suitable. However, one's harness need to be explained for proper appreciation.

I appreciate the view of Rao.
