Querist : Anonymous (Querist) 13 July 2010 This query is : Resolved
R/Sirs,
KIndly advise in case of compulsory retirement one year back ,though quickly filed APPEAL to Appellate Authority &filed OA under Sec19 for quashing order & Interim prayer for keeping in abeyance the compl. Retirement order. CAT on admission stage disposed of & ordrerd Appellate Authority to consider pending Appeal & also to note points raised in OA. Meantime after service of OA order , Appellate Authority decided pending Appeal with few days back order, upholding Compl. retirement.
My query is can I go to High Court only for challenging Interim order? advanceTHANKS.

No point in going to the high court against the interim order as the authority has already passed the order keeping the direction of CAT in mind. Rather you pray for additional relief by challenging the confirmation of the compulsory retirement of as per the directions of CAT.

No. U have to go back to CAT if U feel aggrieved.
