sir,
in private institutions,the jobs are given with a contract letter of 12 months after completion of 12 months they orally say we want to extend your service and again give 12 month contract letter but they didnot mention the date properly like from sep,2010 to 31 aug,2011 like that that doesnot shows any continuation of service at the place and sometime they even dont give contract letter but pay the salary and if we want them to permanent our service they say we cant.this is becoming trend in most of all private organization whether it is colleges,or hospital or other institution or organisations. iwant to know how we can legally solve this problem.

Since it is in private sector,you have to take proceedings individually. No collective action can be taken.The aggrieved can file suit before the civil court challenging the unfair pratices of the employer.

Unfortunately the court is helpless in such cases.Previously,the courts used to term this as "unfair" practice, however, with the advent of globalisation, the courts also have become pro-employer.
In the private sector,the courts, unless a person was a 'workman',had no authority to direct permanency & the only remedy was & still is 'monetary compensation' by way of Damages.
