inheritance of property

(Querist) 30 September 2010 This query is : Resolved 
A & B are in possession of a house which was constructed by their great grand father about 100 years ago. they dont have any document to show that property belonged to their great grand father. now A&B want division of the property among themselves.what procedure is to be followed ?

The property could be partitioned by mutual understanding and thereafter they can obtain declaration from the court. Otherwise, they can file a civil suit for partition, in which the above fact can be mentioned.

It is to mention all the facts of the Old House when it was constructed , by whom and since how log you and your forefathers had been /are in exclusive possession of the House with reference to the Municipal / GP /Certificates from Tax assessment Registers which will show the age of the Building and names of the persons who were/are recorded as owners of the property

If both a and b are ready to partition of that property by mutually, Registered Partition Deed or Settlement Deed are advisable.

If any dispute arisen then file a partition suit in the jurisdictional Hon'ble Court.

Either amicable partition or the suit for partition is the option.

I hope you might have property tax assesment cards and receipts.
Then it is enough and you can make a partition deed and you can directly register the same in the office of the registrar concerned.
The duty and fee for the same is also less
