Bail for co-op society

Querist : Anonymous (Querist) 01 December 2011 This query is : Resolved
A Compliant is lodged against Society, and also against all Office bearers, in a cri case. The case is false, filed for unequal water supply by one of member, who is harassing Society Mg Committee.

Can Experts reply, whether Society, as a accused, need to arrange for bail/ Surety?

Do all 5 Mg committee members + 1 Society need separate Surety?/

Devajyoti Barman (Expert) 01 December 2011
The office bearers who name has been mentioned in the FIR needs to get bail first.

you mean Only the Office bearer?
Raj Kumar Makkad (Expert) 01 December 2011
Society is not a person so it cannot be made an accused rather the office bearers in their official capacity shall have to face the case.

I advise to go for quashing of FIR as this is very untenable case. Administration of water is not an offence.
Sailesh Kumar Shah (Expert) 01 December 2011
yes, only all persons.
DEFENSE ADVOCATE.-firmaction@g (Expert) 01 December 2011
unless all the members are arrayed in the complaint otherwise it will be formal bail to the society represented by some dully authorised person.

Hear again if no person is mentioned in the complaint it will be sufficient ground for revision.
