Per diem allowance

Can an Indian closely held company pay USD 100 per diem allowance for 60 days to a non employee of the Company? Will it be taxable? Will it be treated as Deemed Dividend if the receipient is related to the share holder?

Per diem allowance for what purpose that matters. Your query is not complete. The question is not whether the person is a shareholder or a non-shareholder employee or a consultant/ service provider. All depends upon the nature of service rendered by him to the company.

The diem allowance to be paid by the indian company for his employee residing at USA is fully non-taxable in the hands of the employee.
