Warrant

Querist : Anonymous (Querist) 18 December 2011 This query is : Resolved 
Police received bribe from Complainant and falsely Reported that accused refused to receive Summon, and on such False Police Report, Court issued Warrant.

The accused was not in India at the time and date the Police so reported.
Accused have details to prove, Police did not contact him, as he was out of country.
On receiving Warrant, accused went to court and cancelled Warrant.
Complainant served his purpose to bring accused before the court.

What step accused can take for False Report of Police?
Will the Police be punished??
Damage already done illegally to accused , what is the remedy??

You can file a 340 cr.p.c. petition for giving false information.

As a false report has been produced against you with intent to harm you so definitely you have got cause of action to take strict action against such guilty persons so that it may be lesson not only for them but for all other police officials who generally remain bribed and issue false reports and even put them before concerned court as a result of which the speed of wheel of justice starts its journey on wrong path.

You can file a FIR or a criminal complaint under section 211 IPC against all involved persons apart from filing a complaint under section 340 Cr. PC before tral magistrate.

My meaning is that there are important steps in the case and you must put your energies there, service of summons or police report are minor issues which all courts ignore once you have appeared.

Yes if you have not appeared and gone to higher court than only this issue was relevant now once you have appeared it is history.
