SIR I GOT A NEW NOKIA 5800 MOBILE FROM ONE SHOP ON 06.02.2011. THEY CHARGED Rs.13550/-
ON 20.12.2011 MY MOBILE SOFTWARE DAMAGED, SO I VISITED NOKIA CARE ON 21.12.2011. I THOUGHT THAT MY MOBILE WAS IN WARRANTY PERIOD UPTO 06.02.2012, BUT THEY CHARGED Rs.300/- FOR REPAIR. I ASKED THEM THAT MY MOBILE IN WARRANTY PERIOD THEN WHY ARE YOU CHARGING? THEY SHOWED IN THEIR WEBSITE BY ENTERING MY MOBILE IMEI. IT SHOWED THAT "sold to UAE" HENCE WARRANTY NOT ALLOWED.
THEN I VISITED THAT MOBILE SHOP WHERE I BOUGHT MOBILE AND ASKED ABOUT THAT. THEN THAT SHOP KEEPER TELLING THAT THAT WAS IMPORTED FROM U.A.E, BUT AS MY VIEW ITS NOT IMPORTED. SOMEBODY PURCHASED THAT IN U.A.E AND SELLING THROUGH THAT SHOP. SO, I EXPRESSED MY DOUBT TO HIM. THEN HE REPLIED THAT WHATEVER PROBLEM COMES TO YOUR MOBILE, ITS MY RESPONSIBILITY TO REPAIR IT AND GAVE Rs.200/- FOR REPAIRED CHARGES.
But i am much doubtful on him wether he cheated me, so i want to lodge a COMPLAINT in District Consumer Court. my district is cuddapah, A.P. and the shop is in Chittoor DIST, A.P.
Please give me some advice on this matter wether can i lodge a complaint in consumer court? if so, In which district FORUM i can lodge a complaint? Please suggest a way to give a strong lesson to such shop keepers?

TODAY (19.01.2012) I ENQUIRED THE SHOP KEEPER FOR HIS RESPONSE. HE IS TELLING THAT HIS SISTER IN DUBAI, SENT TO HIM AND HE SOLD IT TO ME AGAIN HE SAYING THAT THIS IS ALSO ACCORDING TO BUSINESS RULES, I DONT HAVE ANY MISTAKE LIKE THAT.

forget it for recovering Rs 200 you will spend more money in legal expnses .
trying to save your time and money .
if however you wan to proceed do you have the bill for rs 13,500/ whether warranty card duly stamoped was given to you ?

You give a police complaint on them, they have cheated you by selling the used one.
The warranty will commence from the date of sale. If you dont have the warranty period, it clearly shows that some body else was holding the phone during the warranty period.
So, give a police complaint.

I agree with Mr Arunagiri,lodge F.I.R against seller as he has sold old and used item instead of fresh and new one.

Agreed with experts
Mr naik had not come out with facts of Bill/ case memo / guarantee cards etc.
If you have, u can get 13lakhs also

You can file criminal case as well as consumer forum case.The mobile sold to you is second hand mobile and not new one.For both cases Chittoor DIST, A.P. where shop situate and purchase was made has the jurisdiction.
