hello all experts how are you hope fine
I am staying in vasai we are in 21 flats co-op housing socitey out of 21 flats 5 flats in rental basic in last month we take socitey meeting that we decided that to take minium rs.150.00 per month for non occupacy charges
pls let me know that what bye-laws of the co-op hsg ltd says to take or not
pls reply asap and send bye-laws order copy

we are not here to furnish you byelaws copies . for that you purchase a copy of bye laws or obtain it from your society office .
please note tythat you cnanot charge more than 10%as non occupancy charges . it is 10%of your service/maintenance charges .

I agree with the Expert. but in practice in mumbai it may vary according to the location and type of society which you stay. Its diff in bandra n worli and diff at diff places. it all depends as stated upon the location valuation and the max as said by our expert 10% of maintainance charges.

Co-op Society can charge max 10% of service Charges, as per monthly maintenance bill of Society to Flat/Shop owner, if it is not occupied by member.
It does not differ from Worli to Bandra; Who told you all such false information, which you publish on public Platform as an Expert Advocate, and your statement is published all over the world.
Pl be responsible for statement made ad be authentic about it..
Bye -Laws of Society are available with Society office.
It cannot supersede Laws Act . even if you pass it in AGM Resolution.
Iqbal, Ask co-op society to strictly follow Laws. , But before that ensure LL who pay NOC, must also strictly follow laws, by Registerinmg LL Agr, get approval of Mg \Comm , when they held meeting every month, and allow outsider to enter Society premises only after written approval of Mg Committee, after obtaining Police Clearance.
You pay 150/- to Society, that will be used for common benefit of all 21 members. All MC members work Honarary, abd those 5 get almost free benefit of all facility.
One of them commit crime and ran away, Police comes 20 times calling MC member to Police station and Court. Owner, investor never come to reside, and create problem for resident member, whose only girl ran away with rental . All at whose cost???
Tenants comes and go away , Shop keeper harass neighbor, my bill unpaid, give information about them . One cannot stop such shop keeper or Police to ring their bell and go with them to answer , even in odd hours of night too. Tenants create lots of problem . Use this address for opening Bank account, ATM, Post Paid Mobile, and taking Loan go away, Who have to answer all, only MC of Society.
Police insists on verification of Tenants. Lots of criminal takes rental flat, commit crime and ran away.
So be legal, and ensure all these too.
Let me know, how many of 5 LL Tenants Registered their LL Agr. ???

You are a member of already formed society, wich fnctions as per the bylaws. The said bylaws are already followed by the managing committee. So contact the managing committee for the same.
Anyways, you are rightly and sufficiently advised by the learned experts above.
