Trouble with fathers property.

I am Smriti Dey from Kadamtala,Howrah,WestBengal.My mother had died early.My father had 12kata land property.My father inherit the property from his father.The total land is in my Grandfathers name.We are two brothers and one sister.all of us is marriaged.After my fathers death when i went my brothers for sharing the fathers property, they replied that before fathers death father went to the court and registered all the property with his sons name.My husband is not economocally sound.I have one unmarried daughter and i can not give her marrige for economical problem.I am now in deep trouble.What can o do legally for get the share of my fathers property?

Dear Querist,


If the property devolved upon father by way of inheritance from his father. It is ancestral in your hands hence you have an equal right by birth notwithstanding the fact that the property was got registered in your brother's name exclusively. You can file a suit for partition and get your share culled out.
