Agreement without stamp paper

Dear Friends,

Can a company make an agreement (payment gateway agreement with a company for using its portal for online payment)on a plain paper insead of stamp paper. What are the legal consequences, if any.

it is basically a contract .necessary to pay stamp duty on contracts entered into between parties

Payment of stamp duty is a must for legal validity of any agreement.

If the Stamp Duty act of your state provides for it then go for it. An agreement however is not invalid for non-payment of Stamp Duty and Stamp Duty and penalty can be paid subsequently.e
