Usage of penthouse

Hi,
This is chirag from Ahmedabad,Gujarat. I am staying in flat at fourth floor,on fifth floor exatly above ther is penthouse. The resident of that penthouse is miss using it by disturing us like playing cricket, doing repairing work, Washing cloth beater hitting etc. which is mentally disturbing us. We have personally requested for not to do this.But they have deneid & said that we will not stop this & will continue. How can law will help us to stop them by doing so? Please guide us for the same as we all family memebers are very much disturb by them.

a member is entitled to do repair work in his house . if society is formed then he has to do after obtaining society permission . generally society while granting permission lays down timings for carrying out repair work . similarly he can wash clothes in his house . you cnat stop him from doing so .

You can make complaint to the society as pollution is dangerous for health and mind. If no action is initiated then you may file a complaint under section 133 of Criminal procedure Code before SDM.
