Mou terms violated..

well we had placed a term in mou before divorce that how can we use it now when man is knowingly not coming for second motion

If either of the parties refuses to appear in the second motion, the other one can do nothing.
If she is wife then she after the dismissal of the MCD may initiate all the proceedings for demanding maintenance and other ancillary reliefs.

I differ with Barman. A fresh case under section 420 IPC can be lodged against husband in the given circumstances apart from initiating both the withdrawn cases from the same stage. So far as divorce is concerned, fresh petition shall have to be filed on the basis of cruelty.
