Agreement as common amenities

Respected Experts,
We and our neighbor have plots adjacent to each other. On these plots we have constructed common building without making any agreement. Staircase, water tank these are the common facilities. We have not formed any society.
Now we intend to make the agreement declaring rights over common facilities like water tank, staircase, etc. Will this agreement be valid in law?. Will it require registration?. How much stamp duty will be required for this agreement in Maharashtra?
Kindly advise.

We are relatives. We did in good faith. Now how to secure the rights of respective parties in order to avoid problems in future in case of dicpute.

There is no problem to execute an agreement even at this stage as this is purely valid in the eyes of law. You may confirm each and every past join action in that agreement and can get the same registered before the registrar and he coast of registration depends upon State to State.
