(Querist) 12 March 2013 This query is : Resolved 
Dear experts,
a person excuted an agrement of sale of shop for a consderation of Rs.5,00,000/- to X.In return X paid Rs.4,00,000/- towards an advance.and balance Rs.1,00,000 has to be paid at the time Registration.But the person did not come farward to excute the Regd. sale deed in favor of X.X filed a suit for specific perpormence.The court is telling that the agrement of sale has to be IMPOUNDED for marking.kindly give a suitable advice in this regard to have justice for X

As per new law, every agreement to sale are required to be got registered and due payment of stamp duty is required to be made. This provision has been made to avoid the situation to which X is facing on today.

Anyway, court can be requested that X is ready to make payment of stamp duty as per law even on today pending the case. Court can allow to first meet out this requirement and then to hear the suit.
