I had applied for certain information (File notes & hearing notes)pertaining to a file from the SPIO in Agriculture department. After 40 days I received a back dated reply stating the information containing file is with the Minister concerned since 06/07/13 under submission and the information can only be released after receipt of the file from the Minister. But there is a history to this file. The Spio who is also the under secretary to the Government is the same person who filed a sworn affidavit before the High Court against a case filed by me for quashing some appointments in a PSU. The information I asked for will show that his sworn affidavit before the Hon'ble HC is wrong and misleading. So I feel that He is withholding the information from me so that I should not prove him wrong. And as the Minister and his office is a public authority under the RTI Act he should have done as per the procedure stated in the RTI Act? Please clarify as to how to take up and with whom for the release of the information.

file an appeal before appellate authority against this letter

File another RTI to the concerned minister office asking the dates when the file was received by his office and how much days it remained with them.
File appeal or the present RTI.
Similar RTI may again be filed by some other person.

As you stated that "sworn affidavit before the Hon'ble HC is wrong and misleading"
then
same shhould be raised before hon'ble high court.
