Rent house evac case in multiple tenants

(Querist) 30 April 2014 This query is : Resolved
Building owner has filed evac case on me and one more tenant. Wanted to understand what impact will other case have on me as if the other tenant win can that be beneficial for my case? And how?

Thanks
Kiran Kumar (Expert) 30 April 2014
well every case has its own merits...the other tenants may have won their respective cases, but the facts and circumstances or the evidence in your case could be different.

But the actual analysis can be done only after perusing the documents so seek opinion of some local lawyer for proper analysis.
Advocate. Arunagiri (Expert) 30 April 2014
If two cases are registered against two different tenants, order passed in favour of one tenant need not be an advantage for the another tenant.

You have to say on what grounds the landlord seeks eviction.

As advised by learned friend Mr Kiran kumar we do not know the real reason about the case. So consult local lawyer is more advisable.

Thanks for your reply. To add the information asked:
For both - me and the other tenant the reason is same, that owner dont have enough space and requires more of it so need his room back.
Owner is also staying in same building.

Yes, you can refer the case of the other tenant.

case would be decided separately on merits. You can refer the decision of another case in your favor.

Thank you very much for your advise.

And if the other tenant loose the case , then can that have an adverse effect on me? OR in that case i can say that the owner's necessity of extra house space is now fulfilled?
OR rather as the owner lost the other case & for bonafied reason, will it make his case strong to evac me?
Kiran Kumar (Expert) 07 May 2014
Well now the settled position of law is that a tenant cannot dictate terms to the landlord. If there is a genuine or bonafide need or personal necessity of the landlord then eviction shall be ordered by the court.
