I AM A TANENT IN KANDIVALI MUMBAI
WE ARE LIVING IN THIS PAGHDI RESIDANCE SINCE 38 YEARS
NOW A BUILDER COME FOR RE DEVELOPMENT BUT HE OFFERS ONLY THE LIVING AREA HE IS NOT GIVING THE BALCONY AREA ALSO
PLEASE SUGGEST ME WHAT TO DO
AND WHAT IS THE AREA WE HAVE TO DEMAND FROM THEM

you are entitled to no less area than what you ere enjoying except those which are proportionally deducted dues to new sanctioned building plan.

You should not agree if offered less area than entitled.

Sir,
Legally you can demand the carpet area that is under your occupation now.
However it is seen in such cases that if all the tenants unite they can bargain a better offer from the builder/developer.
You are advised not to hand over possession of your rental premises to the builder/developer/owner unless a sale deed of the new alternative accommodation is
registered in your favour.

if builder is giving you ownership flats grab the offer .
