Receipt of payment

(Querist) 11 October 2014 This query is : Resolved 
the owner of a property i want to buy wants me to pay rupees one lakh as token money. would it be sufficient to obtain a handwritten receipt on plain paper from him. Or should i use stamp paper. what kind of stamp paper?

in case of a fraud will the handwritten receipt on plain paper with his signatures and thumb impression serve as sufficient evidence in court, or should i do something else.

handwritten receipt is sufficient. But, you need to affix a Revenue stamp of Rs.1/-. The issuer of the receipt shall sign across the revenue stamp. it is advisable to take the thumb impression also.

It is also advisable to get it attested by a witness.

enter into MOU with seller mentioning terms of your agreement the total consideration, the time period for payment of balance consideration, description of the property, etc . in the vent seller refuses to honour the MOU you can move court for necessary reliefs

I completely agree with the views of Mr. Sethi. Only by observing the suggestion made by Mr. Sethi, one can ensure that the purchase of the property takes place in future in favour of the buyer. Without such a procedure, and by getting a simple receipt, the buyer cannot ensure that the property will be sold to him/her.

Enter into an agreement duly drafted by your lawyer, also take receipt. Effect payment by cheque.
