Our Father and Mother are no more. Property belonging to our Father is up for sale and the buyer is seeking bank loan. We are 3 brothers and 2 sisters. The property is roughly 25 years old flat. We have all documents to support the property including Legal heir certificate and respective death certificates.
Bank is trying to say that we should change the property to our name in the revenue office before making sale inspite of Legal Heir and Death certificate available. Is it justified ?

The bank is wrong in saying so.
Ask your buyer to look for another bank which will understand the correct legal position in this regard.

Ask the Bank to get legal opinion from their legal adviser in the matter. If Bank does not agree ask the buyer to change the Bank.
