Police filed a charge sheet against one accused and trial started.Charge framed and some witness examined.In the meanwhile Police filed a report us 173(8) crpc stating that the accused is not the real culprit and a new pereon arrayed as accused.What is the procedure to be adopted for trial- The existing trial and the new trial against the new accused?

its late now, in state cases, if u want to exit from case during investigation, u can go for B false report. and can also file appln for discharge frm charge and do hearing before charge n get the order, now in ur case evidence started , so hostile wittneses is the only remedy n judgmts pronounces , if its private complt then withdrwl of case is remedy. u didn't tell which case it us state case or pvt complnt.
even in pvt compnt sometimes cops investigation r included.
