Rule of primogeniture

Plaintiff filed a suit for partition against his brother regarding patilki inami lands. The defendant elder brother raised objections as he being the elder son, the patilki inami lands will become his independent properties.

Whether the rule of primogeniture is applicable to the elder son? or the younger son will get is share in the properties.

Prima facie, the land is situated in Mharashtra. And all the inams have been abolished long back.
