Adultery

(Querist) 03 October 2016 This query is : Resolved 
> My wife is having affair with married man
>The man often visits her in her rented flat
>What should I do:
*Can I inform & file FIR in the local Police station when the man is in her Flat
* Is the Police bound by law to take the FIR under section 497
*Should I advice them to conduct medical test on my wife & the man when they are caught in the flat
* Should I dial police cntrol no 100 & inform them to come to the place where the man is with my wife
* Or it it better to go to local police station & then inform them which I feel they may refuse to take my complaint.
Please advise point by point on the above queris please

Sir,

You can collect the evidence first, mere visit does not make that person liable for 497 IPC. 497 requires high degree of proof.....

Visit of stranger to meet your wife in your absence does not prove adultery even prima facie and any complaint to Police , I am afraid, would come to a naught.

In another independent thread, without giving reference to this thread, you tried to stress upon that I was wrong in asking you the background of any case history, merely on the basis of your statement that you have already stated about the affairs of your wife. Merely your statement about her affair cannot be the background of the case.

So, now please clarify about the following points, as of background of the case history:

1) Since when she is living separately?

2) What is the real cause of her living separately from you?

3) Has she filed a dv, dowry or divorce case against you or you have sought for divorce from her?

4) What evidence you have collected about her affair with some other man?

5) Suppose she notices some woman often visiting you, like you, would not she also be free to assume that you have an affair with that lady?

6) If a man often visits her in her rented flat, cannot he be her relative or a sincere friend intending to meet her to help against your ill intentions to harm her matrimonial interests, domestic violence let loose by you and your family members or being harassed for money or property from her parents?

So, before seeking any solution, you must provide facts on the above mentioned points. Otherwise, there is no reason to assume that your question is merely a hypothetical academic query without any problem being faced by you.
