Hi all,
first of all i m writing this to know the rules n regulation of labour in an organisation i have been working in a retail store at highway nh-58 the timing of store opening is 7 am till 11 pm at night, this firm is register under company laws.my problem is that i daily travel around 45 km one sided to reach at store by the mode of bus regularly near 7 am & spent 10 hours at store till 5 pm under my shift.But some times if other guy not available i have to closed the store till 11 pm after that its not gonna possible to reach my hometown in that case company provided the room not food & all & continously joined the store at 7 am in that case company provided the salary on double bases is it right way ??? but problem is that our manager is so rude any problem related to store operation he cut down the whole day & night salary without knowing the facts beside this they provide only 2 week off in a month.so my question is that 1)Overtime wages through law is justify?
2)weekly off through labour law is justify?
3)Mentally & physically harsement by manager in an organistion
4)Molestation of all the people at store through this rigid nature by management
beside this i dont have any appointment letter & doesnt sign any terms & condition though employer but i received my salary in an account .
so, pls suggest us all for logically & legally practises under labour law

Do you have any evidence of this molestation, rudeness, rowdiness,attendance record, time clocked and deduction in salary?
While company gives night stay, double salary then why all of a sudden manager has deducted salary of the day and OT?
Have you been given I.card, PF number, ESIC card, group insurance?
What is break up of your monthly salary?

kumar sir,
1)i have attandance sheet soft copy & salary sheet for the month of jan
2)owner given the power to the manager to cut any staff salary in term of work related issues
3)company cant deduct p.f but our sales staff have a esic card and they also suffers the same.
4) salary sheet not provided by the company instead they transfer salary in account.
so, pls shows us the way how to work in this enviorment either we loosing our jobs or cutting our wages in the same way.Also, pls try to stand in our way to know the fact actually.this firm is establised in Uttar pradesh

Mr. Rishabh Rai,
By the way, what do you want to convey by the term molestation, which denotes, usually undesired sexual behavior by one person upon another. Are there lady employees also in your store, who are made to bear with the sexual behaviour of their superiors?
Some separate solution would be required for that issue.

However for your information and knowledge, since your store is located in UP, as per the U.P. Shops & Commercial Establishments Act 1962, the followings are the provisions for the employers to comply:
1. No employer shall allow its employee to work for 8 hours a day.
2. However an adult employee may be deployed on work for 10 hours in a day provided total number of overtime hours should not exceed 50 hours in a quarter.
3. An employee shall be paid twice the rate of wages for the overtime period
4. An employee shall be provided not less than half hour's rest after 5 hours of continuous work and total working hours 12 hours in a day.
5. Every shop or commercial establishment shall remain closed one day in every week and on public holidays.
6. An employee shall be entitled for earned leave of 15 days, sick leave of 15 days and casual leave of 10 days in each calendar year.
But, if your employer or manager has been harassing you, you may approach to the labour inspector of your city for redress of your problems.
