reopen after arguments

(Querist) 26 February 2010 This query is : Resolved
Can a bank reopen after arguments are over in DRT? If yes, are arguments conducted again?
R.R. KRISHNAA (Expert) 26 February 2010
Yes it is possible.

But it is permissible only when the matter is not reserved for judgment. If the matter has been reserved for judgment, then there is no chance for reopening in view of the supreme court ruling that a matter reserved of judgment cannot be reopened.

Otherwise it can be reopened.

yes a bank can reopen the matter at any stage, with permission of court. because the court has inneharant power.
Dr C Suresh (Querist) 26 February 2010
Matter is reserved for judgment. Even if a bank can open again, will the arguments be held again?
Adinath@Avinash Patil (Expert) 26 February 2010
YES BANK CAN REOPEN THE MATTER WITH THE PERMISSION OF COURT EVEN IF MATTER IS RESERVED FOR JUDGMENT.
B K Raghavendra Rao (Expert) 27 February 2010
In my opinion, once the matter is posted for orders/judgements, it cannot be recalled to its previous stage.
