Power of Attorney

I am a NRI. I have given POA to my father to deal with the property in India. POA is duly signed/attested by Embassy in the foreign country where I work and reside.

Should POA be signed/attested by notary in India or signature from POA holder (my father) is enough?

Your father will have to subit that POA to the Collector for affixing Indian Stamp Duty,then only it will work in India.

It is also subject to a specified time frame. Otherwise POA can be held invalid

your father has to get the POA document registered at India. Within 4 months of time of execution of the document it must be registered.

Till the action (ie., property sale/lease) is not completed or the Principal (ie., yourself) cancels the GPA, it is valid.

POA has been made recently so from timing point of view its not out of period (of 4 months).

But,

* What's the process to get it registered?
* Is it sufficient if my father signs in front of notary and then notary stamps it?
* Can POA be used before it is registered?

Authentication of signatrure of yours is important.When you submit the power to Collector or Dy.Collector,he will order to affix proper stamp and then your fathercan get it registered with the sub registrar for registration.

I am not sure if last reply (from Mr. Niranjan) is related in my case.

I am a NRI and POA is already signed/attested by Indian Embassy in the foreign country. Now POA has been sent to my father in India for his signature.

Now the question is what he has to do/follow.
* Just sign as POA holder in the POA document?
* Sign in front of notary or any other authority? Notary counter-signs?
* Any stamp duty?
* Doesn't stamp from Indian embassy already make the document legal and valid?
* What my father has to follow to start using this POA?
