HELLO SIR/MADAM


The person is absconding from 5 years and if a criminal cases are pending in on him from 5 years, when can the court declare that the person is dead,
and if court declare, then the person wife is eligible in getting the L.i.c policy money? if so, pls kindly suggest how to deal it..

No. Such a declaration has to be made only in a suit filed with a prayer for declaration that the person is civilly dead. Pls consult your lawyer.

the period is seven years. after that period only a person can be presumed to be dead under law.

with the copy of the court order stating presumed to be dead you can approach LIC for the claim.
