Sir,
I acuired a property in chennai frm my mother through sale deed. this property was my fathers self earned property bought in my mothers name. my father first wrote a will in my name in 2005 and wwhen my brother started making trouble abt this my father did a sale deed of this house in my name in 2007, the document is signed by my mother as the property is in her name. my mother had a bit mental problem, like she is irritant and gets angry very easily, but she was in no medication or under any treatment. now my parents are no more. at this time my borther is threatening me to sue against me saying that i have cheated my mentally ill mother and acuired this property. is it possible to do so. my mother gave this property with her full mind only, she wasnt even willing to talk to my brother because of some family problems. please answer me as i am in great mental trauma because of this.

As there is no evidence of mothers'mental illness,your brother ,even if he sues,shall not succeed .

Such threatening has no value in the eyes of law. As you had purchased the property against valuable consideration and sale deed is duly registered so there is no scope to reverse the clock. You be happy and enjoy full ownership rights. No one can harm you.

I fully agree with the views of Mr. Prabhakar and Mr. Makkad. Please indicate whether your father or any other relation were the witnesses to the sale deed?

my father wwas there but he didnt sign on the document as wwwas adviced that blodd relation cannot sign as witness. but the deed is signed by other witnessess and registered. my father has the habit of wwriting diary and i have kept all his diarys safe. he has mention ed in his diary about all this problem and his strong decision that this property belongs to me only. will the diary be used as a proof in court.

As already opined by the other Experts, you need not worry. You are on a stronger wicket. Of course keep safe whatever additional supporting documents (like your father's diary etc.) that you have. I was in my own way just trying to know as to who were the witnesses.
