Possession of land

(Querist) 09 December 2011 This query is : Resolved 
my problem is i purchase the share of my uncle from property which was jointly owned by my father n uncle sale deed was executed on 9th november, n sale deed is with me now, he asked few days to give possession now a month has passed but all he is giving is lame excuses....
wat is the remedy available to me??????
plz help.....

file a case for eviction and declaration case.

Try to settle the matter out of court, as he is your nearest relative.The problem may be solved through family elders.If such efforts fail then issue a legal notice for eviction through your local lawyer.

Yes, try your best for amicable settlement.Possession is a necessary element of a sale deed.In case he now promises any time get some agreement done with him after consulting any local lawyer to avoid many fold difficulties and complications that may arise.

If you can forcibly take possession with the help of your father then it can be done because your uncle has already given possession to you in writing. You can obtain a stay order against him to take forcible possession and then do what has been suggested and if he do not come out then file a petition seeking contempt of court.

Dear Sham, never go for forcible dispossession, which would be contrary to law and if you do so your uncle would have the legal right to get the possession back with due process of law. you have purchased the property must have submitted sale deed for incorporating your name in the records of right. bettter all experts who advised to follow path of peace with amicable talk to preserve the good family relations. if not possible approach to court claim specific relief for possession. for details meet your advocate.
