Eligibility for govt job while 498a case is pending?

(Querist) 12 March 2015 This query is : Resolved
My brother recently got the offer letter of a govt job. I do not know anything about police verification for character and antecedent form. 1.How it is done?
There will be an option like - is any case pending against you? Yes/no
Trial has not started but giving maintenance to his wife every month.so,
2.what should we tick- yes or no ?

P. Venu (Expert) 12 March 2015
A pending case is does not affect his eligibility. However, disclose the complete information, as sought in the Attestation Form.

Thank you sir. One more thing to know, if we select 'yes' by disclosing the information, will there be any chance that they will terminate the offer?
Devajyoti Barman (Expert) 13 March 2015
yes, disclose everything. The police will submit a report whether any FIR against him is lodged locally or not.
Devajyoti Barman (Expert) 13 March 2015
Pray to god that govt does not take adverse noting of the pending 498A case which is a criminal case.
P. Venu (Expert) 13 March 2015
Government cannot take any adverse view or deny employment because of the pending case.
shubhamdas (Querist) 13 March 2015

You should not hide any material information in the form.

Your brother's employment will remain safe. But to keep him away from the harassment by the police at the time of verification, do not state anything in the form which could be interpreted as furnishing wrong information. Most worse position can be attaching the salary for payment of maintenance if any, ordered by courtin future.
