I have requested the issue of birth certificate for my late mother at district court in Gujarat near Bharuch city in May 2010.
I have provided all documents and completed all requests made by the Judicial Magistrate First Class.
We have had 6 hearing so far and every time the Magistrate request irrelvant information or the re-calling of evidence from preson who have already appeared.
After 4 months, the Magistrate refuses to pass verdict and his action now clearly appear to be harssement or gross incompetence.
What actions can I take to lodge complaint against him?

Query is not clear. You need birth certificate or death certificate? Both certificates are issued by the local Municipality not by the JMFC.

I need a birth cert. There was no birth entry made for my late mother, hence I have to go through district court to request entry made in birth registry for issue of birth cert by the municipality of births.
Th problem is the JMFC is dragging this case for no apparent reason. I would be happy if he passed any verdict. This is plain and simple harssement in my opinion. What does one do in this situation? Is there a tribunal? Any authority to monitor or complain on the behaviour of JMFC.

Action of a judge in discharge of his duties as judge cannot be complained against. He has immunity against his action. You can question his action only in legal forum by way of an appeal. You may question the decision in the high court.

Under the birth and death register act, a judicial may direct the concern authority for register any birth or death.. If he not satisfied with your evidence mean you have to make satisfied him. Except that you don't have any other legal way..

A further information for you.. For complete any formalities... Court may order for register your mother's death certificate. Surely you can't get her birth birth certificate. Because you can't get birth certificate for any one who is already expired..

There are procedures for making a complaint on the Judicial Officer. Delaying the proceedings for few months can not be a ground for a complaint on a Magistrate.
