This query is : Resolved
I was working as a partner in a partnership firm engaged in the business of Contractor having three partners vide a partnership deed which was AT WILL. We all three partners have decided to dissolve the said partnership firm.
Now, I wish to start the business as the propreitor of new concern and will do the same business which was being carried out by the partnership firm.
Kindly let me know with relevant details -
Whether my work experience as partner in the partnership firm will also be considered as my individual work experience and can be taken into account for my proptreitorship concern.

YES. YOU CAN COUNT YOUR EXPERIENCE IN THE PARTNERSHIP FIRM AS YOUR EXPERIENCE.

But not as an individual. You will have to clearly mention about the experience as partner in the erstwhile firm duly naming that.
But, if some one questions you to submit proof, what document you would like to submit for that purpose?
So, better prepare a former dissolution deed and make mention of all the points that may help all the partners in their individual businesses and to serve the purpose as a certificate of experience.

Sir,
Thanks.
I was really looking after the proof, how can I justify my work experience as partner to that of my individual for my propreitorship concern?
We have dissolved the firm by a Memorandum of Understanding duly signed by all the three partners and we are not working in the name of the said firm.
Is there any case decided on this particular issue which I can submit as proof that 'Experience of a partner in a firm can be treated as his individual experience for his propreitorship concern after dissolution of the partnership firm'.
