PF to Legal Advisor

I am an advocate. i am retainer in a company. For said service, the company gives retainer ship fee. Now, company is eligible for Provident fund. company also offer me to join Provident fund scheme. Can i do so ? please advise.

You need to be an employee to join the PF scheme, which means that you will need to suspend your practice at the Bar Council. If you want to continue as a retainer but aim at a compulsory saving scheme, you may open a kind of compulsory savings account like PPF and you may talk to your client [company] so that they may remit certain portion of retainer fee in your PPF account.

Under the EPF scheme, an employer can enrol as members all categories of employees including the employees engaged by or through contractors and also piece rated, hourly rated employees.

So, now it depends upon you whether you want to be treated as an employee of the company and to leave regular practice, or to maintain your independent identity.

However, if you want to enrol in any provident fund scheme, the PPF would be better for you, which any member of the public, irrespective of his status or profession, can open in a bank or Post Office with all the facilities of provident fund and tax rebates, etc.

You are a legal advisor yourself.
In spite of the clear answers by Mr. Bharat, still you are asking whether you can join EPF. I am afraid you have not even understood what Mr. Bharat has told, otherwise you would not be persisting with your queries.
