(Querist) 06 April 2012 This query is : Resolved 
Sir please enlight me the following few lines which are relating to the contens of a Public Document given in one of the judgments of SC.
"The Check Memo which is requred to be maintained by the officer in charge of the counting table is a document forming record of the acts of a public officer and therefore, a certified copy thereof given by the collector in whose custody the document is kept, can be admitted in evidence in proof of the contents of the original document"

Sir doubt is regarding contents of a public document need not be proved. The above para relates to my doubt or anything else. i mean sir contents of a public document related issue only na sir.

The above para of SC judgment whether it relates to contents need not be proved of a public document or any thing else.?

It does not say that the contents need not be proved.
Such documents are admissible as evidence, but the contents need to be proved before the court.

The para did not give any such interpretation. What it says is that a certified copy can be admitted in evidence in proof of the contents of the original document. In nutshell what the judgement said was, certified copy is as good as original document for production as evidence. It did not say that contents of the document need not be proved.

Contents may be false., need to be proved. Public Document can be exhibited, but subject to cross examination. admitted, exhibited and proved are all three different things.

Public documents enjoy presumption of their
correctness hence their formal proof is not required but such presumptions can be rebutted by the party assailing them.

The contents would anyways need to be proved by the recordkeeper.

When a certified copy of public document is produced it would be presumed to be correct in every respect including its' contents and only party assailing it would be required to prove the contrary by whatever evidence the same may be done. may be summoning the original.
