Inheritance

Hello Experts !!
My mother has a property in the form of a Residential Flat in her name.

She has two sons and no daughters. She has 5 sisters who are all married.
My query is based on Muslim Law, will we the two sons by default inherit the Property or does my Mother need to make a Gift deed to ensure that the entire Property is paased on to only her sons.
The query is based on the Muslim Law requiring the property to be distributed among the Relatives.

Kindly advise.

There is no need for your mother to make a gift deed. Both of you her sons would inherit equally, unless you have your father alive. If your father happens to be alive then he will get 1/4th share of the property left behind by your mother, and you both sons would get equal share of the remainder 3/4th share.
