Dear All
I had brought a flat in 2005 alongwith the parking slot .A seperate agreement was created for this parking but it was not registered between me and the seller.
Post 2010 and the new rules issued by the Supreme Court
quite a few members of our society park their 2 wheelers in my parking slot (although they do not obstruct my vehicle) and also we have a large parking slot .
My question is what are the legal options available to ensure no one parks their vehicles in the vacant slot .
Can someone stop me if i buy a second small car and park it in the vacant slot .
Since this is a flat purchased in 2005 will the ruling be applicable to this transaction too .
If i were to sell the flat can i transfer the same to the new buyer .

has the society approved transfer of flat with car parking slot ?
till date society has not made any efforts to cancel your parking slot . you continue to be owner of flat with slot .
SC has held that builder has no powers to sell the parking slot and it forms part of common area .
as long as society does not take any action you continue to be owner of slot

Thanks for the reply ...but i am sure the Managing commitee and their cronies have in the past tried such stunts but it has failed because of strong opposition from all members .
Is their any legal recourse as and when the society decides to do so and can i objet the parking of 2 wheelers in the vacant slot adjacent to my stilt parking whcih actually belongs to me ...

You can definitely raise in the meeting og society as well as to registrar.
