Hi, this is Mohit from Delhi.
Just wanted to know whether is it possible to see my grandfather's will. Grandfather died few years ago and his three sons including my father who is the eldest, didn't see the will or no one has shown the same to him. Don't know whether there was any will or not. Now, the younger two sons have sold the ensister property without discussing my father (eldest son) and neither told us about the money transaction. Now, how to see the original will.
Please help.
Thanks Mohit

check with sro if any will was made and if registered , then only you can find there.

YOUR FATHER'S BROTHERS CANNOT SELL THE PROPERTY WITHOUT PROPER WILL/PROBATE. FROM WHERE YOU HAVE COME TO KNOW THAT PROPERTY HAS BEEN SOLD.

@Mr Rao-- sro means? will sro give us the information, means is he the person who keeps the information of all the wills. Also what all docs should we carry when we meet him. Also do we need to contact the local Sri of the city.

@Mr Kumar--- our relatives told us that these people have sold the property to some builder and the builder has constructed around 15 flats over there each costing around 30 Lac initially. Now the two brothers are staying somewhere else in Aligarh.

You can very well verify the truth of the information that the land has been sold and flats have been constructed. You can also obtain particulars of the sale from the Registration Dept, if the information is true.
Further course of action could be worked out thereafter with the assistance from a local lawyer.

SRO stands for SUB REGISTRAR OFFICE -WHO DEALS WITH PROPERTY REGISTRATIONS AND RECORDS IN ALL STATES.
IN SOME STATES,the inspector general registrations and stamps (IGRS) have websites also from which we download property E.C etc..

Only those WILLS registered with sub registrars can be traced by inspection.
But a will can be unregistered also.
If the property is in UP, requirement of probate/or letter of administration is not
a legal necessity.
In my opinion ,instead of doing pillar to post here and there, sellers and buyers should be served with a notice drafted by a lawyer, alleging the sale void for your father's share, hopefully,at least vendee would reply and facts at other side shall get revealed for future action.Non reply may lead to a suit.

I agree with the expert advise by Mr. Prabakar Singh on this issue. Sen a legal notice to all the purchasers, wait and proceed with proper legal action after reply notice from them.
