Sir,
my married life has been left 3 year I lived with my wife and a baby girl 1.5 year far from my parents 200 Km.now my wife is unsatisfactorily behavior to me and my parents. she is went to home town with her brother and baby girl. Now my question is if she is file Dowry Act than how safe me and my parents from misuse Dowry Act.

Continuously talk to her and her family members on telephone and try to record the conversation. Try for amicable solution with the help of elders and common friends.

Sir,
I have been tired to persuade her lasr 2.5 year more than 20 times I have do this because her father has been late 6 month before my marriage after that she does not understand my feeling I dought sone one told her why you have not file dowry act. now it is over what are the procedure to misuse of Dowry Act

If she is not ready to live with you, try for amicable settlement and file Mutual Consent Divorce.

If you file divorce case a series of cases i.e dowry, domestic violence, maintenance etc. would be started against you and your family. You may not be able to get divorce in next 5-6 years in a contested case.

You should file a petition under section 9 of restitution of conjugal rights as she has left your company since last more than 2.5 years without any reason.

What were you doing during the elapsed period of 3 years?
Has she been contacted by you?
What sort of attempts you have made to reconcile and bring them back to stay togather?
Initiating legal course of action detriorates the situation.
It would certainly be better to talk to her and settle the issues amicably, if cannot do alone, seek help from elders, relatives, friends and/or acquientances etc.

filing RCR is time tested toll to invite dowry allegation (even if wife is avoiding to do so) as she will be compelled to state some reason or the other which justifies her desertion.

Any legal action being taken by you will certainly provoke her resulting into the apprehended false dowry case, cruelty or domestic violence case, you have to be prepared for any eventuality in case you are advised to file a divorce case against her by your lawyer. So, better think of any possibility for a reunion, or you can go ahead with the proposed divorce case.
